CONDITIONS OF BUSINESS

(Effective April 1, 2021)


Conditions & General Information:

By requesting the booking of a tour through Playfair Golf Travel, LLC (we/us/the Company), you agree to be bound by these terms and conditions. When you contact the Company to book your tour, you appoint the Company to act as your agent to obtain the requested services for you. When the Company has done so and you have confirmed the booking and paid the deposit, the relevant providers of the services you have booked are responsible for providing your vacation from that point onwards. No employee or representative of the Company has the authority to change these conditions or information. This Agreement shall be governed by the substantive laws of the State of Tennessee, without giving effect to any conflict-of-law rules of such jurisdiction. You irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within Davidson County, State of Tennessee, United States of America.

Planning Fee:

You agree to pay a non-refundable planning fee of $100 person, or such other amount as determined from time to time by us.

Deposit & Final Payment:

Deposit and final payment amounts and due dates vary by program, and are detailed in the reservations material of the applicable program. If a payment is not received by the due date, reservations are subject to cancellation and deposits shall be forfeited.

Cancellation and Refunds:

Notification of cancellation by a client must be sent in writing to the Company. Cancellation charges vary dependent on the travel package purchased, and are as stated in the travel package documentation. In the event there is no such statement, payments are non-refundable. No refund will be made for unused portions of a travel package. The Company has the right to charge cancellation fees to the credit card you authorized to pay for travel services, or to deduct from the supplier’s refund or to invoice you. PLAYFAIR GOLF TRAVEL SHALL NOT BE RESPONSIBLE FOR A SUPPLIER’S FAILURE OR REFUSAL TO MAKE A REFUND WHETHER OR NOT PROMISED BY THE SUPPLIER.

Currency Fluctuations:

Currency exchange rates fluctuate. Prices are subject to change based fluctuations. PLAYFAIR GOLF TRAVEL IS NOT RESPONSIBLE FOR PRICING CHANGES OR OTHER IMPACTS FROM CHANGES IN CURRENCY EXCHANGE RATES.

Air and Other Travel:

Unless stated otherwise in writing, airline reservations are not included. Making air arrangements, and arranging transportation to and from the destination where the travel booking originates and returns, are your responsibility. Airline tickets for travel on scheduled airlines, if they should be obtained for you by the Company, are a separate item outside the travel package, and may carry change and cancellation penalties as specified by the carrier. The Company accepts no responsibility for any aspects of airline travel, including but not limited to flight delays, missed connections and lost luggage, which are the sole responsibility of the relevant carrier. Transport by aircraft, rail, ship, coach, taxi or similar will depend on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation, and applicable provisions of law and treaty.

Documentation:

For US citizens, a current passport is required for overseas travel. Vaccination records and Covid-related documentation may be required. It is your responsibility to check for visa, vaccination and other requirements as appropriate for your destination. You are responsible for ensuring that all passports and visas and other documentation required for your trip have been obtained, that visas for each country are valid for entry and exit dates of your visit, your personal details in the passport and visa are accurate and match your ticket/s, and your passport is valid for at least six months beyond the completion date of your trip. Issuance and possession of a passport and visa does not assure entry or exit. Each country is a sovereign government. Even with a passport or visa, a local immigration officer and other authorities can decide whether to allow or refuse entry. These decisions may be based on factors set by the law and rules and current policies of that nation, over which the Company has no control.

National Refusal of Entry or Exit:

Some countries restrict or refuse entry or exit due to criminal offenses. These can also include past offenses that may seem minor or that would not be an offense currently (for example, past alcohol or drug-related offenses). If you or someone in your group has a current or past offense, even minor, your entry or exit may be refused or delayed. You are responsible for checking with authorities of each country you may enter or exit for current entry and exit requirements and restrictions.

Changes:

We reserve the right to charge an administrative fee in an amount of our discretion for changes you request after a deposit has been received and confirmation issued. In most cases, changes cannot be made less than 60 days before travel.

For various reasons, changes in itinerary may be necessary. These include but are not limited to severe weather, political or civil events, international incidents, illness and disease, or other condition or circumstance. Changes may be made at our discretion and subject to each supplier’s terms. A property, supplier, activity, area or other aspect of an itinerary may be replaced or deleted.

Name Changes:

In the event you wish to change the name of one of the golfers previously confirmed on a trip, in addition to our administrative fee as stated above, there may be nonrefundable deposits paid to golf clubs which prohibit transfer of deposits.

Responsibility:

The Company acts only as agent in securing and booking the tours, and/or the golf courses, hotel accommodations and other land tour services provided by others as independent contractors. You authorize the Company to book with third parties to fulfill your travel requests, and on your behalf to accept the third party terms, which may limit your rights. You agree to bound by such actions. Separate supplier terms will apply to your reservation and purchase of travel. You agree to abide by the terms set by us and any supplier that provides services related to the travel, including but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that violation of a supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, you and your group being denied access to flights, hotels, cruises, or automobiles, forfeiting monies paid for the reservation(s) or purchase, and the Company charging you for costs we incur due to the violation. You shall be responsible for charges, fees, duties, taxes, and assessments arising out of your travel bookings through us. In any conflict, inconsistency or ambiguity of terms, the Company will benefit from the terms or interpretation most favorable to the Company in each instance.

Our business model is based on acting as your agent in booking a full package of tee times, accommodation and ground travel. In the event you make your own reservations for any of those elements, we reserve the right to charge a commission as if we were making those arrangements on your behalf, or to cancel all reservations and cease acting as your agent. In case of the latter, you accept that such cancellation may not lead to a refund in full, and you accept full responsible for any consequences arising from such cancellation.

NOTWITHSTANDING ANY OTHER TERMS AND CONDITIONS, THE COMPANY ASSUMES AND ACCEPTS NO LIABILITY WHATSOEVER IN RELATION TO TOURS, INCLUDING BUT NOT LIMITED TO LIABILITY FOR INJURY, LOSS, DAMAGE, ACCIDENT, DELAY, CHANGES OR INCONVENIENCE HOWSOEVER CAUSED, INCLUDING BUT NOT LIMITED TO ANY OF THE AFOREMENTIONED CAUSED BY: ANY EVENT OF FORCE MAJEURE; HEALTH RISKS; DISEASES; INFECTIONS; WAR OR THREAT OF WAR; RIOTS; CIVIL STRIFE; TERRORIST ACTIVITY; INDUSTRIAL DISPUTES; ACTS, OMISSION, NEGLECT, DELAY OR DEFAULT OF ANY PERSON ENGAGED IN PROVIDING ANY TOUR SERVICES INCLUDING TRANSPORTATION AND ACCOMMODATION; TECHNICAL PROBLEMS TO TRANSPORT; CLOSURE OR CONGESTION OF AIRPORTS OR PORTS; BUILDING WORK; EXTENDED HOTEL CLOSURE; CANCELLATIONS, DELAYS OR CHANGES OF SCHEDULES BY AIRLINES; INTERRUPTION OR FAILURE OF PUBLIC UTILITIES; AND STORMS, TEMPESTS AND HURRICANES. THE COMPANY IS NOT LIABLE FOR LOSS, DAMAGE OR THEFT OF LUGGAGE OR PERSONAL BELONGINGS, FOR PERSONAL INJURY, ACCIDENT OR ILLNESS ON ANY VEHICLE OR AT ANY PLACE THROUGHOUT THE TOUR.

Travel Insurance:

We strongly recommend that you take out appropriate travel protection, cancellation and interruption insurance and air medical transport membership at or before the time of booking. If you do not take out travel such insurance, you acknowledge the risks of such inaction.

Travel Risks:

Travel involves many risks. Risks include but are not limited to disorientation and becoming lost, criminal activity, unrest, hostilities, dishonesty of merchants and others, physical violence, misunderstandings due to differing languages, misunderstandings due to differing customs, weaker food or water safety, lack of sanitation, different or insufficient medical and health care facilities and care, weather, natural disasters and misunderstandings with law enforcement and government officials. Travel in some destinations involves greater risks in some categories and in other destinations greater risks in other categories. You are responsible for staying informed of current news, and reviewing travel prohibitions, warnings, announcements and advisories issued by the U.S. Government prior to booking and traveling to international destinations. Information on conditions in various countries and levels of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov. For example, the Travel Advisory webpage of the U.S. State Department is at https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/. The Smart Traveler Enrollment Program (STEP) is a free service of the U.S. Government to U.S. citizens who travel to, or live in, a foreign country. STEP lets you enter information about your upcoming trip so the Department of State can better assist you in an emergency. Registration is recommended and can begin at https://step.state.gov/step/.

BY DESCRIBING, OFFERING OR ARRANGING TRAVEL TO DESTINATIONS, PLAYFAIR GOLF TRAVEL DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS OR AREAS IS ADVISABLE OR WITHOUT DANGER OR RISK, GENERALLY, OR FOR YOU OR YOUR GROUP, OR IN YOUR CIRCUMSTANCES. TRAVEL TO A DESTINATION THAT MAY INVOLVE RISKS ACCEPTABLE TO SOMEONE ELSE, MAY NOT BE RIGHT FOR YOU, YOU MUST ANALYZE AND MAKE YOUR RISK ASSESSMENT AND DECISION YOU CONSIDER RIGHT FOR YOU. PLAYFAIR GOLF TRAVEL SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. YOUR PARTICIPATION CONSITUTES ACCEPTANCE OF SUCH RISKS.

Golf Handicaps and Course Conditions:

Many golf clubs require visitors to show handicap cards. While this is not particularly common we strongly recommend that you travel with a handicap card, and accept no responsibility if you do not and are subsequently denied golf. Certain clubs also place maximum handicap restrictions on visitors. If your handicap is greater than 24 (men) or 36 (ladies) please notify us so that we can discuss which clubs may have relevant restrictions. Also, please note that the Company can accept no responsibility for the playing conditions of any golf courses, including changes caused by course maintenance or weather conditions.

Caddies:

If you request caddies, the Company will forward a request for caddies in advance of your trip. The golf clubs will make every effort to secure caddies, but they are neither employed by the golf clubs nor by the Company or any other tour service provider. If a caddie is secured for you, the caddie master or another club official will confirm the caddie charge and tipping policy on the day.

Required Mobility & Fitness:

Golf, especially outside the United States, may require a certain level of fitness and mobility in order for full participation. Carts may not be allowed without a doctor’s note and/or may not be available. Activities may include walking over uneven or rough surfaces, stepping on/off buses, and walking up/down stairways where elevators do not exist. This list is intended as representative but is not exhaustive. If you or a member of your group has any concerns over fitness or mobility levels, this should be discussed with the Company in advance of booking any trip. Ultimately, participants themselves are the only people who can fully assess their capability to manage any of the activities offered, and so once booked, the Company will not offer any refund or accept liability for any traveler who is subsequently unable to participate (or may be prohibited from participating by any third party operator or any other relevant authority) in any activity due to their limited fitness or mobility levels.

Indemnity:

You agree to indemnify the Company in full against and hold harmless the Company from any and all claims, costs, damages, liabilities, expenses (including but not limited to legal expenses) demands and judgements awarded against or incurred or paid by the Company as a result of or in connection with any and all acts or omissions of you and your travelling companions.

Waiver:

Any of these term or conditions may be amended or waived if, and only if, the amendment or waiver is in writing and signed by a member of the Company. Our failure or delay of enforcing any of these terms and conditions shall not be a waiver of our right later to enforce each and every term of these terms of use. Any waiver by us on any one or more occasions will not be construed to be a waiver of any succeeding or other breach.

Interpretation:

If any provision of these terms and conditions is unlawful, void or unenforceable, it shall not affect the enforceability of the remainder of the terms and conditions. Rather, the unlawful, void or unenforceable provision shall be modified so that it is valid, legal, and enforceable and to the fullest extent possible, reflects the intention of such provision.
